How to Find Education Cases

** Reading human rights cases can teach us what our rights are and how they will be interpreted by the tribunal or courts. As it is important to understand, “It is how our rights are defined.” We also need to look at how the tribunal will interpret the school’s behaviour as unreasonable or reasonable.
P.A.T.H is based in British Columbia (BC), Canada. Cases that are outside of BC are not binding, but they may be influential. School district lawyers will be aware of them and will use them in their arguments.
Our rights are not unlimited. They are defined by case law and tribunal decisions.
** If you are navigating the human rights tribunal process, or are thinking about it, it is important for you to review case law in human rights decisions.
Many parents have been self-representing, and some have hired lawyers. With these decisions, even ones that have not technically been successful for the family on an individual level, many of them have provided our community with gold nuggets that we can use when advocating. For that reason, I pour my heart out fully to all of you who have navigated this process. These decisions are GOLD and are priceless.
